01 Introduction & Definitions
1.1 Purpose: These Terms of Use ("Terms") govern your use of the Cannulix platform. Cannulix reserves the right to amend these terms at any time. Continued use of the platform after updates constitutes acceptance.
1.2 Definitions:
- "Cannulix" / "Platform": Refers to Cannulix Healthcare Technologies, a lead generation and aggregator platform based in Hanumangarh.
- "User" / "Patient": Any individual registered on the platform to request services.
- "Service Provider" / "Partner": Independent third-party professionals (Nurses, Labs, Physiotherapists) who are NOT employees of Cannulix.
- "Lead": The contact information and requirement details of a User shared with a Provider.
02 Eligibility & Account Security
2.1 Eligibility: You must be at least 18 years of age and a resident of India to create an account. If you are booking for a minor, you represent that you are the legal guardian.
2.2 Account Responsibility: You are responsible for maintaining the confidentiality of your login OTP/password. Cannulix shall not be liable for any loss due to unauthorized access resulting from your negligence.
2.3 Accuracy: You agree to provide accurate names, addresses, and medical history. False information may lead to immediate suspension.
03 Description of Services
3.1 Aggregator Model: Cannulix is a technology facilitator. We connect Users with independent Service Providers for home nursing, lab tests, and elder care. We do not provide medical services directly.
3.2 Service Availability: Services are currently limited to Hanumangarh Town, Junction, and immediate outskirts. Response times (e.g., "Nurse in 60 mins") are goals, not guarantees.
3.3 Custom Requests: Prescription uploads via WhatsApp are subject to provider availability. We act only to forward these requests to relevant pharmacies or labs.
04 Booking Process & Emergency Protocol
4.1 How to Book: Users select a service, verify via OTP, and confirm booking. The initial booking on the app is free (₹0 Platform Fee).
4.2 Confirmation: A booking is considered confirmed only upon receipt of an SMS/WhatsApp notification assigning a Service Provider.
05 Payments, Commissions & Refunds
5.1 Direct Payment: Cannulix charges ₹0 booking fees from the User. The User must pay the agreed service charge directly to the Service Provider via Cash or UPI upon service completion.
5.2 Provider Commissions: Cannulix generates revenue by charging a commission/lead fee to the Service Provider. This is an internal arrangement and does not affect the User's payment obligation to the Provider.
5.3 Cancellations: Users may cancel a booking up to 30 minutes before the scheduled time without penalty. Repeated no-shows may result in account blocking.
06 User Obligations
To ensure safe service delivery, you agree to:
- Medical Disclosure: Provide truthful information regarding the patient's condition, infectious diseases (e.g., HIV, Hepatitis), and allergies.
- Conduct: Treat Service Providers with respect. Any form of harassment, abuse, or illegal activity will be reported to law enforcement.
- Data Consent: You explicitly consent to sharing your location and medical details with the assigned Service Provider to facilitate the home visit.
07 Provider Relationship
7.1 Independent Contractors: Service Providers are freelance professionals or third-party agencies. They are not employees or agents of Cannulix.
7.2 Verification: While Cannulix verifies basic certifications (e.g., Nursing Registration, NABL Lab status), we are not liable for the Provider's day-to-day actions or professional judgment.
7.3 Quality Assurance: Cannulix reserves the right to delist Providers based on User feedback and poor performance ratings.
08 Intellectual Property
8.1 Ownership: All content, logos, designs, and code on this website are the intellectual property of Cannulix. Unauthorized copying is strictly prohibited.
8.2 User Content: By submitting reviews or testimonials, you grant Cannulix a perpetual, royalty-free license to use them for marketing purposes.
09 Disclaimers & Health Risks
9.1 No Medical Advice: Information on this platform is for general awareness. It is not a substitute for professional medical advice from a doctor.
9.2 "As Is" Basis: Services are provided on an "as available" basis. Cannulix makes no warranties regarding the accuracy of lab reports (generated by third parties) or the outcome of nursing procedures.
9.3 Health Risks: Medical procedures involve inherent risks (e.g., bruising from injections). Cannulix is not liable for common side effects where standard protocols were followed.
10 Limitation of Liability & Indemnity
10.1 Liability Cap: To the fullest extent permitted by law, Cannulix’s liability shall be limited to the value of the booking or ₹1,000, whichever is lower. We are not liable for indirect or consequential damages.
10.2 Indemnity: You agree to indemnify Cannulix against any claims, losses, or damages arising from your misuse of the platform, violation of these Terms, or false medical disclosures.
11 Termination
11.1 By User: You may delete your account at any time by contacting support. Data will be retained as per our Privacy Policy.
11.2 By Cannulix: We reserve the right to suspend or terminate access without notice if you violate these Terms, engage in fraud, or abuse Service Providers.
12 Disputes, Force Majeure & Misc
12.1 Governing Law: These Terms are governed by Indian laws. Any disputes are subject to the exclusive jurisdiction of courts in Hanumangarh, Rajasthan.
12.2 Force Majeure: Cannulix is not liable for failure to perform due to events beyond control, including pandemics, strikes, natural disasters, or internet outages.
