01 Definitions & Scope
1.1 "Cannulix" refers to Cannulix Healthcare Technologies, a sole proprietorship/private limited company registered in Rajasthan, India, acting solely as a technology intermediary.
1.2 "Service Provider" or "Partner" refers to independent medical professionals (Nurses, Physiotherapists, Labs, Doctors) registered on the Platform to offer services.
1.3 "User" or "Patient" refers to any individual accessing the Platform to request medical services for themselves or a beneficiary.
1.4 "Lead Generation" refers to the core activity of Cannulix, wherein the Platform identifies a User's requirement and forwards the contact details to a relevant Service Provider.
02 Nature of Platform (Aggregator Model)
It is hereby explicitly clarified that Cannulix is NOT a hospital, nursing home, or medical establishment under the Clinical Establishments (Registration and Regulation) Act, 2010.
- No Employer-Employee Relationship: The Service Providers visiting your home are independent freelancers or third-party agencies. They are NOT employees of Cannulix.
- No Medical Advice: Any information on the website is for educational purposes and does not constitute medical advice.
- Platform Role: Our responsibility is limited to verifying the basic credentials (KYC) of the Service Provider and connecting them to the User.
03 Role of Service Providers
The Service Provider is solely responsible for the medical procedure, diagnosis, and treatment outcomes. By using Cannulix, you acknowledge that:
3.1 The Agreement for service is directly between the User and the Service Provider.
3.2 Cannulix does not guarantee the punctuality, medical expertise, or behavioral conduct of the Service Provider, although we strive to onboard only verified professionals.
3.3 Any medical equipment (IV stand, Oxygen, etc.) must be arranged by the User unless the Service Provider explicitly agrees to bring it.
04 User Obligations & Safety
To ensure a safe environment for healthcare delivery, the User agrees to:
- Full Disclosure: Provide accurate medical history, allergies (especially to antibiotics like Penicillin), and current medications.
- Safe Environment: Ensure the home environment is safe and hygienic for the professional to operate.
- Respectful Conduct: Treat the visiting nurse/doctor with dignity. Any form of harassment (verbal, physical, or sexual) will be reported to law enforcement immediately.
05 Payments & Billing Structure
Cannulix operates on a "Direct-to-Provider" payment model to ensure transparency.
5.1 No Platform Fee for Users: Users are not charged any booking fee by Cannulix. Our revenue is generated via a "Lead Commission" charged to the Service Provider.
5.2 Settlement: The User must pay the agreed service amount directly to the Service Provider via Cash, UPI, or Direct Bank Transfer upon completion of the service.
5.3 Receipts: Since the transaction is between User and Provider, any demand for a tax invoice (GST) or receipt for insurance claims must be made directly to the Service Provider. Cannulix cannot issue medical invoices.
06 Limitation of Liability & Indemnity
You agree to indemnify, defend, and hold harmless Cannulix, its owners, and affiliates from any claims, damages, losses, or legal fees arising from:
- Your violation of these Terms.
- Any dispute between you and the Service Provider.
- Any adverse medical reaction where the Provider followed standard protocols.
07 Emergency Protocol
WARNING: Cannulix services are strictly for non-emergency, elective, and planned home care (e.g., dressings, routine injections, physiotherapy).
In case of chest pain, severe breathing difficulty, stroke symptoms, or heavy bleeding, DO NOT WAIT for a home visit. Call 108 (Ambulance) or visit the nearest Trauma Center immediately.
08 Data Privacy & Lead Sharing
8.1 Consent to Share: By submitting a booking request, you explicitly consent to Cannulix sharing your Name, Address, Phone Number, and Patient Condition with potential Service Providers in your vicinity.
8.2 Communication: You agree to receive transactional updates via WhatsApp, SMS, or Voice Call regarding your booking.
8.3 Data Security: While we implement standard encryption, we cannot guarantee security against advanced cyber-attacks. User data is retained only as long as necessary for service fulfillment.
09 Code of Conduct & Termination
Cannulix reserves the right to blacklist or block any User or Service Provider who:
- Abuses the platform to solicit services bypassing the lead system.
- Engages in misconduct, violence, or inappropriate behavior.
- Repeatedly cancels bookings without valid reason.
10 Governing Law & Jurisdiction
This Agreement shall be governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Hanumangarh, Rajasthan.
