Terms of Service & Liability Waiver

MANDATORY AGREEMENT: By accessing Cannulix, submitting a booking request, or communicating with us via any digital medium, you unequivocally agree to be bound by these Terms. If you do not agree to these terms, particularly the liability waivers, you must immediately cease using the platform.

01 Introduction & Definitions

1.1 Purpose: These Terms constitute a legally binding agreement between you ("User", "Patient", "Guardian") and Cannulix ("Platform", "We", "Us"), governing the use of our digital aggregator platform.

1.2 Definitions:

  • "Cannulix": A digital lead-generation and technology aggregation platform. Cannulix is NOT a hospital, clinic, healthcare provider, or clinical employer.
  • "Service Provider": Independent, third-party medical professionals (Registered Nurses, Phlebotomists, Physiotherapists) who accept leads from the platform.

02 Strict Technology Aggregator Role

2.1 No Medical Practice: Cannulix operates strictly as a technology facilitator bridging the gap between care seekers and independent medical professionals. Cannulix itself does not practice medicine, nursing, or offer clinical diagnoses.

2.2 Logistics Only: Our sole function is the transmission of your service request to an available independent professional in your vicinity. The actual provision of healthcare services is an independent contract strictly between you and the Service Provider.

03 Emergency Medical Disclaimer

DO NOT USE THIS PLATFORM FOR MEDICAL EMERGENCIES.
Cannulix is designed for scheduled, non-emergency, routine medical support. In the event of a heart attack, stroke, trauma, severe bleeding, breathing difficulty, or any critical condition, you must immediately call 108 or proceed to the nearest hospital casualty department. Cannulix bears zero liability for delays or outcomes in emergency scenarios.

04 User Obligations & Consents

4.1 Truthful Disclosure: The User is entirely responsible for providing accurate patient history, current medications, existing allergies, and infectious disease status (e.g., HIV, Hepatitis) to the Service Provider. Cannulix is not liable for adverse reactions caused by concealed or inaccurate medical history.

4.2 Safe Environment: The User must provide a safe, hygienic, and abuse-free environment for the visiting Service Provider. Any threat or harm to the provider will lead to immediate legal action and platform ban.

05 Independent Provider Relationship

5.1 Independent Contractors: All Service Providers are independent contractors/freelancers operating under their own respective professional licenses and independent clinical judgment. They are not employees, agents, or representatives of Cannulix.

5.2 Liability Transfer: Because Cannulix does not employ the Service Providers, Cannulix holds no vicarious liability for their actions, omissions, negligence, or misconduct. Any clinical dispute, claim of medical negligence, or malpractice rests entirely and exclusively with the individual Service Provider.

06 Platform Disclaimers & General Risks

6.1 "As Is" Basis: The platform and coordination services are provided on an "as is" and "as available" basis without any warranties, express or implied, including guarantees of specific recovery outcomes or specific response times.

6.2 Medical Outcomes: Medicine is not an exact science. Cannulix does not guarantee any specific cure, relief, or medical outcome resulting from the services procured through our platform.

07 Explicit Assumption of Risk

7.1 Inherent Medical Risks: The User acknowledges that all medical and nursing procedures (including but not limited to IV insertions, injections, catheterizations, and wound dressings) carry inherent clinical risks, including but not limited to infections, phlebitis, bruising, allergic reactions, or unforeseen complications.

7.2 Waiver: By requesting a professional through Cannulix, the User explicitly understands and voluntarily assumes all such inherent medical risks, completely holding the Cannulix technology platform harmless.

08 Absolute Limitation of Liability

8.1 Cap on Damages: To the maximum extent permitted by applicable Indian law, Cannulix, its founders, directors, and technology administrators shall UNDER NO CIRCUMSTANCES be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to personal injury, wrongful death, medical complications, or emotional distress arising out of or related to the services rendered by the independent Service Provider.

8.2 Maximum Liability: In a jurisdiction where complete liability waiver is not permitted, Cannulix’s total cumulative liability for any dispute arising from platform usage shall not exceed the technology facilitation fee (if any) paid to the platform, or ₹1,000 INR, whichever is lesser.

09 Indemnification

You agree to fully defend, indemnify, and hold harmless Cannulix, its founders, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your violation of any term of this Agreement.
  • Your failure to provide accurate medical information to the visiting professional.
  • Disputes arising directly between you and the independent Service Provider.

10 Founder Credentials & Non-Clinical Status

10.1 Degree Acknowledgment: The founder and administration of Cannulix hold a degree in B.Sc. Nursing. This credential is utilized internally to establish stringent verification, quality control, and onboarding standards for independent partners.

10.2 No Direct Clinical Relationship: The operation of the Cannulix platform does not constitute the practice of nursing by the founder. Registering on the app, requesting a service, or interacting with support does NOT establish a direct nurse-patient clinical relationship between the User and the founder/platform administration. The founder assumes zero personal medical liability for the actions of the independent contractors operating in the field.

11 Governing Law & Dispute Resolution

11.1 Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of India. Any legal disputes, claims, or proceedings arising out of this agreement or platform usage shall be subject to the exclusive jurisdiction of the competent courts located in Hanumangarh, Rajasthan.

11.2 Severability: If any provision of these Terms is deemed invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.
